Class Action Lawsuit for disabled employees

If you are an employee who has a targeted disability, even if you have never identified yourself to the Agency as such read these letters. (The name of the AFGE representative has been changed, the letter has not been changed.).

The attorney who initiated these letters has withdrawn from the case. New Attorneys are now working on it.

In the course of ongoing litigation before the Equal Opportunity Employment Commission, the Social Security Administration has been ordered to send a copy of the attached letter to its employees who voluntarily identified themselves as having certain disabilities on the Office of Personnel Management's Standard Form 256 or using the Agency's on-line Employee Data System.

The Agency is sending you this letter so that you have the opportunity to decide for yourself whether you wish to participate in this potential class action litigation and contact the prospective class attorneys in this matter. Your participation in this matter is voluntary and optional.

The Social Security Administration is committed to the goal of a fair and equitable workplace where it is possible for all employees to reach their potential and be successful.

Good morning Mr. Snider,

I wish to know if an employee who has one of the targeted disabilities (management has knowledge of the disability) but she was never aware of Form 256 or that it had to be submitted (see below memo from Mark Anderson) might have the same opportunity to join the class action complaint?

Excellent question.  The answer is: YES.  TDE (Targeted disabled employees) are eligible to be included
WHETHER OR NOT they ever fillled out a Form 256 or otherwise self identified.
